Welcome to Great Plows! The terms “we”, “us” and “our” refer to Great Plows. Great Plows operates this store and website, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services. By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent and warrant that you are the age of majority in your state or province of residence. The Services are intended for adults and are not directed to children.

To use the Services (including making a purchase), you may be asked to provide information such as email, billing, payment, and shipping details. You represent that such information is accurate and that you have the right to provide it. You are responsible for safeguarding your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account.

SECTION 2 – OUR PRODUCTS

We strive to describe products accurately; however, appearance (including colors) may vary by device. We do not warrant that products will meet your expectations or exactly match images. Product descriptions, availability, and pricing may change at any time without notice. We may limit quantities or sales by person or geography.

SECTION 3 – ORDERS

Your order is an offer to purchase; we may accept or decline at our discretion. We must receive and process your payment before acceptance. We may be unable to cancel orders once accepted. If we decline, modify, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

Your purchases are subject to these Terms and our posted policies, including the Shipping & Pickup Policy and Refund Policy, which are incorporated by reference.

Freight-requiring items. For products that ship via freight, shipping costs are not calculated at checkout. After purchase, we will provide a freight quote and invoice; the order will not be released for shipment until that freight invoice is paid. See our Shipping & Pickup Policy for details.

You represent and warrant that purchases are for your own use (not for resale or export), unless we agree otherwise in writing.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place the order and will appear in your confirmation email. Unless expressly stated, posted prices exclude taxes, duties, shipping/freight, handling, customs, and import charges. You agree to provide current and accurate payment information and authorize us (and our processors) to charge amounts due, including applicable freight once quoted and approved.

SECTION 5 – SHIPPING, DELIVERY & PICKUP

Shipping, freight, and pickup options are described in our Shipping & Pickup Policy, which is incorporated into these Terms. Eligibility for pickup and specific shipping options appears at checkout based on inventory and location.

Risk of loss. Title and risk of loss pass to you upon delivery of products to the carrier (or, for pickup, upon transfer to you or your agent). Delivery timelines are estimates and not guarantees. We are not liable for delays caused by carriers, customs, weather, or events beyond our control.

SECTION 6 – INTELLECTUAL PROPERTY

The Services (including trademarks, text, images, graphics, video, audio, and their arrangement) are owned by Great Plows or its licensors and protected by law. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly provided.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to the third parties’ terms.

SECTION 8 – THIRD-PARTY LINKS

Third-party materials and links are provided for convenience. We do not control or endorse them and are not responsible for their content, policies, products, or services. Access is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted by Shopify. Sales are between you and Great Plows. Shopify is not responsible for your purchases or any resulting injury, damage, or loss. You release Shopify from claims arising from your transactions with Great Plows.

SECTION 10 – PRIVACY

Your use of the Services is subject to our Privacy Policy and to Shopify’s privacy terms where applicable. Because the Services are hosted by Shopify, certain information may be processed by Shopify and its service providers, including across borders, to operate and improve the Services.

SECTION 11 – FEEDBACK

If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose. You represent you have the rights to submit Feedback and it does not violate others’ rights or applicable law.

SECTION 12 – ERRORS, INACCURACIES & OMISSIONS

Information on the Services may contain errors or omissions (including product descriptions, pricing, promotions, shipping charges, transit times, and availability). We reserve the right to correct and update information or cancel orders if information is inaccurate at any time without prior notice (including after submission).

SECTION 13 – PROHIBITED USES

You may not use the Services for unlawful purposes or to violate laws; infringe rights; harass or harm; transmit malware, spam, or deceptive content; scrape or interfere with security; or otherwise engage in conduct that we determine may harm Great Plows, Shopify, or users. We may suspend or terminate accounts for violations.

SECTION 14 – TERMINATION

We may terminate or suspend access to the Services at any time in our discretion. You remain liable for amounts due up to the termination date. Sections intended to survive termination will continue to apply.

SECTION 15 – DISCLAIMER OF WARRANTIES

Except as expressly stated by Great Plows in writing, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free use. Some jurisdictions do not allow certain disclaimers; those may not apply to you.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GREAT PLOWS OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SERVICE PROVIDERS, OR LICENSORS (OR SHOPIFY AND ITS AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Great Plows, Shopify, and their affiliates, officers, employees, and agents from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, applicable law, or third-party rights.

SECTION 18 – RETURNS, REFUNDS & WARRANTY

All sales are final. Due to the nature of plows and heavy equipment, products are not returnable or exchangeable once ordered and fulfilled. Freight and related charges are non-refundable. See our Refund Policy for details.

Manufacturer warranty & service. Great Plows is an authorized dealer for Arctic and Metal Pless. Warranty and service issues are handled by the manufacturer; we will assist you in initiating a claim. See our Shipping & Pickup Policy for how freight and pickup are coordinated.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver. These Terms and the policies referenced herein constitute the entire agreement between you and Great Plows regarding the Services and supersede prior agreements. Any ambiguities will not be construed against the drafting party.

SECTION 21 – ASSIGNMENT

You may not delegate, transfer, or assign these Terms or your rights or obligations without our written consent; any attempt is void. We may assign or transfer our rights and obligations without consent or notice.

SECTION 22 – GOVERNING LAW

These Terms and any disputes arising from the Services are governed by the laws and courts of the jurisdiction where Great Plows is headquartered, without regard to conflicts of laws rules. You consent to venue and personal jurisdiction in such courts.

SECTION 23 – POLICY INCORPORATION & CONFLICTS

The Shipping & Pickup Policy, Refund Policy, and Privacy Policy are incorporated into these Terms. If there is a conflict between a policy and these Terms regarding a specific topic, the applicable policy controls for that topic.

SECTION 24 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 25 – CHANGES TO TERMS

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes to our website. Where required by law, we will provide notice of material changes. Your continued use of the Services after changes are posted constitutes acceptance.
